Tydal Group Pty Ltd (trading as Tydal Agency) (“Tydal”, “we”, “us”, “our”) is an Australian brand and experience design agency. By using our website or engaging our services, you agree to these Terms and Conditions.
1. Services
We offer brand strategy, visual identity, graphic and digital design, engagement campaigns, and related consulting. All project scopes, deliverables, timelines, and fees are confirmed in written proposals or agreements.
2. Client Responsibilities
Clients must provide accurate information, feedback, and approvals in a timely manner. Delays in client input may impact project timelines.
3. Fees and Payment
Fees are detailed in project proposals. Payment terms are confirmed for each project. Late payments may incur interest or suspension of work.
4. Intellectual Property
Final deliverables, once paid for in full, are transferred to the client. Drafts, working files, or rejected concepts remain the property of Tydal unless expressly agreed otherwise. Tydal retains the right to showcase completed work for portfolio and promotional purposes unless otherwise agreed.
5. Confidentiality and Privacy
We respect client confidentiality and comply with the Australian Privacy Act 1988 and APPs. Any sensitive project or business information shared will be protected and not disclosed to third parties except as required by law or with written consent. See our Privacy Policy for more information.
6. Limitation of Liability
We will deliver work professionally and as agreed in the proposal. Tydal is not liable for indirect damages, loss of profit, or issues arising from client misuse or further modification of deliverables. Maximum liability for any claim is limited to the total fees paid by the client for the relevant project.
7. Website Use
Content on our website is for information only. You must not copy, reproduce, or distribute it without permission. Tydal is not responsible for third-party links or content.
8. Termination
Projects may be terminated by mutual agreement, for breach of contract, or non-payment. Any work completed to date must be paid for. Tydal may refuse future service to users who breach these terms.
9. Changes to Terms
We may update these terms to comply with changes in law or business practices. Clients will be notified of significant changes affecting ongoing projects.
